Harvey Weinstein granted appeal in New York sex crimes conviction

Disgraced former Hollywood producer Harvey Weinstein has been granted an appeal more than two years after he was convicted of third-degree rape and other crimes.

New York's highest court agreed on August 19 to hear Weinstein's case after the appellate division, a lower court, upheld his conviction in June, a spokesman for the Court of Appeals announced on Wednesday.

Chief Judge Janet DiFiore granted Weinstein's leave for appeal, saying there are "questions of law are involved which ought to be reviewed."

The former Hollywood mogul was convicted in New York in February 2020 for sexual assault and rape and was sentenced to 23 years in prison.

He has argued certain testimony allowed at the 2020 trial was improper and a juror who wrote a novel about "predatory older men" should have been disqualified.

Weinstein’s attorneys have until Oct. 18 to file a brief with the court to start the appellate process.

"He's hopeful that the court is going to find that he did not receive a fair trial and reverse his conviction. And, as he has consistently, he maintained his innocence," said one of his lawyers, Arthur Aidala.

Following investigations from the New Yorker and the New York Times in 2017, over 80 women accused Weinstein of sexual misconduct. Those allegations helped spark the global #MeToo movement, a social movement against sexual abuse and sexual harassment.

Weinstein has, however, denied the allegations and said that any sex was consensual.

He was also found guilty of rape in the third degree for assaulting former aspiring actress Jessica Mann in 2013.
